H-1 and H-4 Nonimmigrants Granted Advance Parole May Apply for Extensions |

AILA members who have received denials of H-1B or H-4 extensions based solely on the fact that the alien's last entry was on an Advance Parole should submit inquiries to the CSC using the online form.
The CSC has confirmed that an H-1 and/or H-4 nonimmigrant who entered the U.S. pursuant to a grant of Advance Parole may apply for an extension of H-1 and/or H-4 status if there is a valid and approved petition. AILA members who have received denials of H-1B or H-4 extensions based solely on the fact that the alien's last entry was on an Advance Parole should submit inquiries to the CSC using the online form. The CSC Liaison Committee is preparing a list of erroneously denied cases to be presented to the CSC for correction in 30 days.
