The court concluded that, based on is reading of the plain text of the statute and in deferring to the BIA�s interpretation in In re Smirko, a person who arrives in the United States as a refugee under INA �207 may be removed even if refugee status has never been terminated under INA �207(c)(4). (Kaganovich v. Gonzales, 12/12/06).
